Draft Amendments to Section 11 Rules released

The Medical Practitioners Act 2007 requires all medical practitioners seeking to practise medicine within the Republic of Ireland to be registered with the Medical Council in a Division of the Register which is appropriate to their medical qualifications and training. The Medical Council recently issued draft amendments to its current Registration Rules and Rules Specifying Pre-Registration Examinations and Exemptions for comment by interested parties and the public. These Rules define the manner in which medical practitioners may be registered in the Republic of Ireland.

The draft amendments are as follows:
Registration Rules C.2.(i) and E.2.(i) draft amendment to Category 2
Nationals of a Member State who do not meet the eligibility requirements for category 1 above and have been awarded a formal qualification in basic medical training recognised by the Medical Council under EU Directive 2005/36/EC and possess the required accompanying certificate (if any) listed in the aforementioned EU Directive 2005/36/EC as a requirement for formal qualification within the meaning of the Directive; or have completed satisfactorily internship training in accordance with Medical Council policy and been awarded a document which, in the opinion of the Council, is at least the equivalent of a certificate of experience; or possess a Certificate of Acquired Rights.

Rules Specifying Pre-Registration Exams and Exemptions
Draft amendment to Rules 5.1(iii) and 5.2.(iii)
(iii) Medical practitioners who were registered on the General Register of Medical Practitioners under section 27 (full registration) or 29 (temporary registration) of the Medical Practitioners Act 1978 may be exempt from the PRES when applying for registration.

Rule 5.1(vi) - new exemption for the purposes of trainee specialist registration
(vi) Without prejudice to section 89(3)(a)(i) of the Act, participants in training programmes recognised by the Medical Council for exemption from the TRAS immediately prior to the Register Establishment Day are exempt from the PRES, pending review.

These draft amendments are due to be considered by Council shortly. It was open to the public to comment on them by downloading, completing and submitting a feedback form. The deadline for receiving comments has passed. All submissions received are subject to the provisions of the Freedom of Information Acts 1997-2003.
