What is professional indemnity?

Professional indemnity is a mandatory requirement and will protect the practitioner against claims arising in respect of medical malpractice, negligence and other civil claims that arise from a breach of duty associated with your practice as a doctor.

What are the professional indemnity requirements in Ireland?

All doctors practising medicine in Ireland must have indemnity cover appropriate to the nature of their employment/practice arrangement and their area of practice.

What does your indemnity cover, (and not cover)?

Professional indemnity for the purposes of the Act is concerned with insurance cover for potential negligence actions only. You should bear in mind that the Clinical Indemnity Scheme does not cover complaints made to the Medical Council under Parts 7, 8 or 9 of the Medical Practitioners Act 2007 and you should consider taking out a policy of indemnity to cover complaints before the Medical Council.

What do I need to know before applying for Registration with the Medical Council?

When making an application for Registration, you will be asked to select from a list of options relating to your proposed practice arrangements. Set out below are the six different practice arrangement options available on the application form. If you select an option which requires evidence of professional indemnity, you can upload the relevant document while completing the application online.

The following six practice arrangements will appear on the application form, and you will be asked to select the option which applies to your proposed practice arrangements.

A. If registered, I will be engaged in the practice of medicine exclusively in a hospital and/or healthcare facility that is listed in List 1 (including on a locum basis).
If you choose this option, you will not need to provide evidence of indemnity.

B. If registered, I will be engaged in whole or in part (including on a locum basis), in the practice of medicine as a consultant in a hospital and/or healthcare facility that is listed in List 2.
If you choose this option, you will need to provide evidence of the relevant minimum level of indemnity by way of certificate from your insurer/broker or indemnity provider.

C. If registered, I will be engaged in whole or in part (including on a locum basis), in the practice of medicine in a non-consultant position, in a hospital and/or healthcare facility that is listed in List 2.
If you choose this option, you will not need to provide evidence of indemnity.

D. If registered, I will be engaged in whole or in part (including on a locum basis), in the practice of medicine at an facility (to include a general practice) that is not listed in either List 1 or List 2.
If you choose this option, you will need to provide evidence of the relevant minimum level of indemnity by way of certificate from your insurer/broker or indemnity provider.

E. If registered, I will not immediately be engaged in the practice of medicine under a contract of employment, contract for services or any other arrangement. However, I hope to engage in the practice of medicine during this period of registration.
If you choose this option, you will not need to provide evidence of indemnity.

F. I will not be engaged in the practise of medicine.
If you choose this option, you will not need to provide evidence of indemnity.

FAQ on Professional Indemnity Evidence required based on your Practice Arrangements

What if I am, or will be, employed by a HSE hospital?

All doctors who work wholly and under a contract of employment with the HSE are covered by the Clinical Indemnity Scheme (CIS) and do not need to put in place any professional indemnity arrangements. The list of public (HSE) hospitals as provided by the NTMA is located at the following link Public HSE Hospitals.

What if I will be employed as a consultant in a private hospital?

If you are commencing work as a consultant with a private hospital you will need to put in place professional indemnity arrangements for practice. You will need to ensure you have cover to the minimum levels set out at the following link Minimum Levels of Cover (Appendix A and Appendix B). The list of private hospitals provided by the NTMA is located at the following link Public HSE Hospitals. The Medical Council will require evidence that the correct level of indemnity is in place. Our understanding is employing hospitals will also be seeking this information, as a matter of course before you commence practising in their facility.

What if I will be employed as a consultant in both private and public hospitals?

If you will be working as a consultant in both a public and private hospital settings you will need to put in place professional indemnity arrangements for practice. You will need to ensure you have cover to the minimum levels set out at the following link Minimum Levels of Cover (Appendix A and Appendix B). The Medical Council will require evidence that the correct level of indemnity is in place.

What if I will be employed as a SHO/ registrar (NCHD) in a private hospital?

Non-consultant hospital doctors (NCHDs) working in private hospitals can no longer be covered under a hospital’s group policy and must maintain a personal limit of indemnity of not less than €10 million, as prescribed by the State Claims Agency. A transitional phase is in process to permit hospitals / clinics to fully align with this requirement by the end of 2025. Please contact your employer to confirm indemnity arrangements prior to commencing employment.

If I need to put in place my own indemnity arrangements, what level of cover do I need to have?

You will need to make arrangements with one of the indemnity providers to have in place the appropriate level of cover, as set out in the schedule at the following link Minimum Level of Cover (Appendix A and Appendix B). The Medical Council will require evidence that the correct level of indemnity is in place.

What if I will be working completely outside the hospital system, such as in General Practice or another private clinic?

You will need to make arrangements with one of the indemnity providers to have in place the appropriate level of cover, as set out in the schedule at the following link Minimum Level of Cover (Appendix B). The Medical Council will require evidence that the correct level of indemnity is in place.

What if I will be undertaking locum work in a variety of non-hospital situations?

You will need to make arrangements with one of the indemnity providers to have in place the appropriate level of cover, as set out in the schedule at the following link Minimum Level of Cover (Appendix B). The clinical place(s) where you will work will need to ensure you have the appropriate level of cover in place, before commencing work. The Medical Council will require evidence that the correct level of indemnity is in place.

What if I will be undertaking locum work in a hospital situation?

You will need to clarify with any hospital where you will be undertaking locum work, what indemnity arrangements are in place, given the type of employment. If the hospital indicates you will not be covered by their policy/arrangement, you need to put in place appropriate indemnity cover as set out in the schedule at the following link Minimum Level of Cover (Appendix B).  The Medical Council will require evidence that the correct level of indemnity is in place. The clinical place(s) where you will work will need to ensure you have the appropriate level of cover in place, before commencing work.
